1. ACCEPTANCE OF TERMS
Welcome to the Sun City MacDonald Ranch Community Association Inc. (SCMRCAI) resident pages of "scmronline.com". Following is the current Terms of Use (TOU) followed by your acceptance of this TOU. No one shall be allowed to post on the Associations website without agreeing to the TOU contained in this Agreement and the TOU. By accepting this Agreement, or by actually utilizing the website and making a post, the person agreeing hereto and/or making such post consents to and agrees to be bound by the TOU.
2. USER ACCOUNT, PASSWORD AND SECURITY
You are solely responsible for maintaining the confidentiality of your Login Name and Password, and are responsible for all activities that occur under your Login Name and Password. You shall not let anyone use your Login Name and Password and you agree to immediately notify the SCMRCAI web coordinator () of any unauthorized use of your Login Name and Password or any other breach of security.
3. WHAT IS PROHIBITED
3A. You shall NOT post to the site any illegal or otherwise inappropriate material, including but not limited to, pornographic, obscene or offensive language, graphics, banners or images or any virus, spam, chain letters, pyramid schemes, trojan horse, or other like material; and you shall not use the site or its content in any manner that is patently offensive, including but not limited to posting information, links, or material that includes pornography, promotes racism, bigotry, hatred or physical harm of any kind against any group or individual, that could be harmful to minors, or that harasses, stalks or advocates harassment or stalking of another person or entity.
3B. You shall not post copyrighted material, which does not belong to the author/poster. This includes commercial advertising messages or solicitations or the copying and pasting of material from other websites. You may use a link to reference materials on other sites.
3C. You shall not disclose, disseminate, or use in any manner whatsoever the resident information contained herein, including, but not limited to purposes of solicitation of products or services by mail, telephone, or otherwise, without the express, advance written permission of the individual resident. You shall not attempt to discover, use, copy or modify the information or materials of others or in any way violate their privacy or security.
3D. “PERSONAL ATTACKS” shall NOT be tolerated against anyone including: other residents, board members and employees. It is the intent of SCMRCAI, and it is your shared responsibility to foster and maintain a positive website community. Comment shall be limited to the content, not on the person posting. If you and another User have personal issues to discuss (good or bad), you shall not use this website as a means to communicate them.
3E. Questions or opinions regarding any association business shall NOT be sent or directed to an Association employee or Association manager by means of the website, message board or chat-room. The Association has provided email addresses and phone numbers for your use to communicate directly with Association departments, management and employees.
4. INDEMNITY
You agree to indemnify, defend and hold SCMRCAI, its committees, volunteers, affiliates, directors, officers, agents, partners and employees (hereinafter, collectively sometimes referred to as the “Association Parties”) from and against any and all liabilities, obligations, claims, damages, costs and expenses, including reasonable attorney’s fees, incurred by one or more of the Association Parties due to, arising out of, in connection with, or related in any way to your use of the Association’s website, any postings you place on such website and any possible violations of this TOU or your violation or failure to comply with the governing documents at SCMRCAI.
5. MESSAGE REMOVAL AND TERMINATION
5A1. You agree that a posting under your name may be removed immediately by Community Standards () upon complaint. A notice of removal will be sent to any User who has had a post deleted. The notice will be sent to the e-mail address displayed in the User's Resident Profile. Failure of a User to list an e-mail address in the SCMRCAI User Profile shall be considered a waiver of the right to receive a notice. If an entire thread is deleted, only the User who posted the original message will be notified. If a notice is not removed as a result of a complaint, the person complaining will be so notified by Community Standards.
5A2. An aggrieved User or complainant may contest the removal or lack of removal to the DREC.
5B. You agree that any violation of the TOU by you, including multiple removals of messages by Community Standards, may result in the termination of your use of the SCMRCAI website. The Termination Process may begin with a complaint from another resident or by a recommendation from Community Standards to the DREC. Additionally you are advised that since this TOU is part of the SCMRCAI Rules and Regulations, if you do not adhere to the provisions of the TOU, in addition to the removal of your posts/messages, you may also be subject to other monetary and/or administrative sanctions for violation of the governing documents of this association.
5C. SCMRCAI Board of Directors may at its sole discretion and at any time discontinue providing the scmronline.com website, or any part thereof with or without notice.
5D. You agree that SCMRCAI shall not be liable to you or anyone as a result of the closing of the website, any part or parts of the web site, or the termination of your User LOGIN/PASSWORD.
6. DEALINGS WITH ADVERTISERS
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that SCMRCAI and the Association Parties shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the website.
7. LINKS
The SCMRCAI website may provide links to other World Wide Web sites or resources. Because SCMRCAI has no control over such sites and resources, you acknowledge and agree that SCMRCAI and the Association Parties are not and shall not be held responsible for the availability of such external sites or resources and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that SCMRCAI and the Associated Parties shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
8. DISCLAIMER OF WARRANTIES
This website and its contents are provided "as is" and without warranties of any kind, either express or implied. SCMRCAI does not warrant that this website or its contents will be uninterrupted or error-free or that defects will be corrected. SCMRCAI also does not warrant that this site or the server that makes it available is free of viruses or other harmful components. SCMRCAI expressly disclaims all warranties, express or implied, of any kind, regarding the website, its content, and any other information, material, products or services offered, sold, or displayed on the site, or your use of the same, including but not limited to any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement.
9. NOTICE
9A. SCMRCAI is not responsible for any postings or submissions, which are the sole responsibility of the User. SCMRCAI does not represent or endorse the accuracy, currentness or reliability of any advice, link, opinion, statement or other information displayed, uploaded or distributed through the SCMRCAI Website. You acknowledge that any reliance upon any such opinion, link, advice, statement or information shall be at your sole risk.
9B. If SCMRCAI should fail to enforce any right or provision in these terms and conditions, you agree that such failure does not constitute a waiver of such right or provision, or any other right or provision. If you are aware of any violations of these terms and conditions you may report them to Community Standards ().
9C. You agree to give SCMRCAI exclusive rights to dispose of any and all submissions that you submit to the SCMRCAI Website.
10. HEADINGS
All headings and subheadings employed within this TOU are inserted for convenience and reference only. Headings are not to be considered in the interpretation of any provision of this TOU.
11. INVALIDITY OF A PARAGRAPH
If any section, sentence, or paragraph of this TOU is found to be invalid, void or unenforceable, the remainder of this TOU will continue in force.

12. ACCEPTANCE I have read and accept all the terms of this TOU and agree to be bound by those terms. I unequivocally agree that any complaint or dispute I may have with another User shall be dealt with by me directly and exclusively with that User by a means other than this website. I shall in no way involve SCMRCAI, except as provided in Paragraph 5 of this TOU. I shall not post any comment identifiable with any employee, or attack any Association Party, including but not limited to, any committee member or Board member of SCMRCAI. Additionally, should you have a complaint regarding the performance of any employee of SCMRCAI, such complaint shall be addressed solely by sending the complaint to the General Manager or the President of the Board of Directors of SCMRCAI. |
